A jury delivered a defense verdict in the latest Ethicon pelvic mesh trial held in the District of Colorado after a 9-day trial. Attorneys from Butler Snow’s Pharmaceutical, Medical Device, and Healthcare Litigation Group serve as National Counsel for Johnson & Johnson in the pelvic mesh litigation, and this marks the third straight defense verdict in pelvic mesh trials this year.
The Shostrom v. Ethicon, Inc. and Johnson & Johnson trial began on June 21 and the jury delivered the defense verdict on Friday, July 1, after deliberating for only 55 minutes. Trial counsel from Thomas Combs and Faegre Drinker were supported by Butler Snow attorneys Amy M. Pepke (appellate trial counsel) and Sarah Smyth O’Brien along with a paralegal support team.
Many of the pelvic mesh trials were dormant due to delays related to the pandemic. In March 2022, Butler Snow served as lead trial counsel in McBroom v. Ethicon, Inc., et al. and Shears v. Ethicon, Inc., et al., the first of two pelvic mesh trials held in person since the start of the pandemic. In both trials, the juries returned defense verdicts after deliberating for less than two hours.
