Eric J.R. Nichols of Butler Snow LLP, who represents Parallax, told Law360 on Tuesday that the en banc decision is “entirely consistent with the facts of the case, as well as the governing law.”
“I would be hard-pressed to imagine a greater irreparable harm than a plaintiff losing his, her or its cause of action before it could be presented to a court for resolution,” Nichols said, adding the underlying case is set to go to trial in February.
