Overview

Marshall focuses his practice on appellate law, including providing appellate support to trial teams in state and federal court. Prior to joining Butler Snow, Marshall clerked at both of Texas’s high courts: the Supreme Court of Texas and the Texas Court of Criminal Appeals. Marshall also previously worked as a public affairs consultant and in public policy in the Texas Legislature.  Now in private practice, Marshall applies his acute understanding of appellate and legislative procedure to assist clients with complex problems before and during all stages of litigation.

About

Marshall’s experience includes representing businesses, government entities, and individuals in a wide variety of appellate matters in the Texas intermediate appellate courts, the Supreme Court of Texas, and the United States Court of Appeals for the Fifth Circuit.  Marshall has also advised clients on legislative and regulatory procedures and represented businesses and individuals before the Texas Legislature and Texas state agencies.

He frequently speaks and writes about topics related to appellate law.  He has authored articles, appeared on podcasts, and spoken at continuing legal education events about a variety of appellate law and litigation matters.

Marshall is also an active member of his community.  He currently serves as a Commissioner on the City of Austin Electric Utility Commission, Secretary of the Board of Trustees for the Shield-Ayres Foundation, and on the Boards of Directors for Shield Ranch Foundation, the Texas Advocacy Project, and the Texas Agricultural Land Trust, where he also chairs the Policy Committee.  He is a founder and past-board member of the Regents School of Austin Alumni Network and has helped coach high school students in mock trial competitions.  He is also a member of the State Bar of Texas (Appellate Section), the Texas Bar College, the Pro Bono College, the Austin Bar Association (Civil Appellate Section and Austin Young Lawyer’s Association), the Aggie Bar Association, and the Federalist Society.  Marshall is also a member of the Barbara Jordan Inn of Court.

Marshall obtained his J.D., cum laude, from St. Mary University School of Law, where he served on the editorial board of the St. Mary’s Law Journal and received the St. Mary’s University Presidential Award. He also holds an M.A. in Theology from St. Mary’s University, with honors, and a B.A. in Political Science from Texas A&M University, where he was a member of the Student Government Association Executive Council. He is admitted to the State Bar of Texas.

Experience

  • Marshall’s appellate experience includes full merits briefing in the United States Court of Appeals for the Fifth Circuit, the Supreme Court of Texas, and several intermediate appellate courts in Texas. Marshall has also presented oral argument to the United States Court of Appeals for the Fifth Circuit, in which he obtained a complete victory for his clients. Additionally, Marshall has assisted litigation teams with pre-trial legal analysis and strategy from an appellate perspective and has worked with trial-teams in drafting jury charges and providing counsel on error preservation issues. 
  • Marshall has also assisted clients in navigating the legislative and regulatory process, including drafting and facilitating the filing of proposed legislation, arranging client testimony at legislative hearings, providing legal counsel on pending legislation, advising clients on the necessity and process for obtaining licenses from administrative agencies, and assisting clients in responding to regulatory enforcement actions.
  • Marshall’s litigation experience includes assisting clients in responding to civil and criminal investigative subpoenas, drafting pre-trial dispositive motions in state and federal cases, and assisting clients in managing complex discovery disputes.
