Experience

  • Experience resolving legal issues inside and outside of bankruptcy related to individual and business reorganizations, debt restructuring, insolvency, financial and commercial litigation, workouts, and asset sales.
  • Represents debtors, creditors, and case trustees in bankruptcy cases and proceedings under chapters 7 (liquidation), 9 (municipalities), 11 (reorganizations), 12 (family farmers or fishermen), 15 (cross-border insolvency), and PROMESA (territories).
  • Specialized knowledge about bankruptcy court and bankruptcy appellate jurisdiction, chapter 11 plans and confirmation, leasing issues, bond and note instruments, collateral estoppel/issue preclusion, avoidance actions, and municipal & corporate governance.
  • As a C.P.A. with “big four” auditing experience, he understands the “business side” of clients’ transactions and financial instruments and recognizes the effect on debt covenants, shareholder/member agreements, taxation, and financial reporting. 
  • Experience negotiating and litigating real property matters, including leases, land use, public trust doctrine, and related governmental and environmental questions.
