Experience
- Practiced law for over 40 years in areas of taxation, business, estates, White Collar Criminal Defense and probate litigation.
- Significant experience in probate litigation, corporate, partnership, individual and estate tax planning and transactions, business succession planning, including mergers and acquisitions, reorganizations and joint ventures, and Federal and State tax litigation, including proceedings before U.S. Tax Court, the United States District Courts and Courts of Appeal.
- Serves as an adjunct professor for the University of Alabama Law School.
- Serves as a member of the State of Alabama Ethics Reform and Clarification Commission.
- Recent experience:
- Recently tried US Tax Court case, two others pending, represented clients in sale of their substantial medical practice, appointed by Probate Court to oversee large class-action settlement, litigated probate matter in Circuit Court and on Appeal to Supreme Court of Alabama (successful at each court) and appointed to State of Alabama Ethics Clarification and Reform Commission by Alabama Law Institute and Alabama Legislature.
- Very favorably resolved substantial corporate opportunity litigation on behalf of minority shareholder plaintiff.
- Represented individual before IRS and FBI accused of “structuring” bank deposits so as to avoid currency transaction reporting requirements: no indictment, charges dismissed.
- Represented two former HealthSouth executives (not Mr. Scrushy) who were indicted separately, one of whom was acquitted on all counts after a month-long jury trial; the other’s indictment was dismissed with prejudice.
- Represented multiple bank officials targeted by Office of Comptroller of the Currency and U. S. Justice Department. All cases closed without indictment.
- Represented brokers before S.E.C., FINRA and FBI, and conducted Sarbanes-Oxley corporate internal investigation for public Fortune 500 corporation.
- Resolved favorably two U.S. Tax Court cases.
- Represented companies and individuals in connection with criminal and regulatory investigations, as well as parallel civil and criminal proceedings.
