Mississippi – Shortly before trial in the United States District Court for the Southern District of Mississippi, Butler Snow obtained favorable rulings that excluded the plaintiff’s causation expert and granted a motion for summary judgment on behalf of Varn International, Inc. In this wrongful death action, the heirs of a woman who died from leukemia blamed her illness and death on exposure to a cleaning product that allegedly contained benzene. There was no evidence showing that the product contained benzene. Also, the plaintiff did not offer sufficient evidence to demonstrate that benzene could cause the particular type of leukemia from which the plaintiff died, nor was there any proof that the plaintiff received a toxic exposure of the product in question.
