Public Finance and Incentives

Butler Snow offers a comprehensive and diverse Public Finance and Incentives practice ranging from all forms of state and municipal bonds and obligations to the full complement of techniques available to finance healthcare, industrial/economic development, exempt facilities, utilities, housing and other developments. The firm has served as bond counsel to over two-thirds of the counties and numerous cities, school districts, utility districts and economic development districts in the State of Mississippi. The firm has also served as bond counsel to the State of Mississippi, the Mississippi Hospital Equipment and Facilities Authority, the Mississippi Development Bank and the Mississippi Business Finance Corporation, the latter of which serves as the primary issuer of private activity bonds in the state. The firm routinely serves as underwriter's counsel to many of the largest investment banking firms involved in Mississippi financing.

In addition to our traditional public finance practice, the group works closely with the firm's banking and commercial lending, taxation, real estate, governmental affairs and other practice groups on private project financing, letters of credit transactions, state and local tax incentives and abatements and other financing and transactional related matters.

The nature of public finance work is such that most matters in this area are handled on an alternative fee basis, rather than an hourly rate basis. We work with each client to structure a specific fee arrangement for each matter or project, depending on the needs and goals of the client.
