Todd Photopulos Has Articles Published in Spring Editions of Two Legal Journals

Memphis – Todd Photopulos, a member of the Labor and Employment Group in the Memphis office of Butler, Snow, O’Mara, Stevens and Cannada, PLLC (Butler Snow) authored articles appearing in the Spring editions of two national legal journals.

For Employment & Labor Relations Law, published by the American Bar Association, Photopulos contributed “Kentucky River Trilogy Challenges Big Labor’s Organizing Strategy.”  This article focused on three related decisions by the National Labor Relations Board clarifying the definition of “supervisor” for use in determining eligibility for union membership.  “This standard will have a direct impact on labor’s strategy for organizing, particularly in the health care setting,” said Photopulos.

In Labor & Employment, published by the American Health Lawyers Association’s Labor and Employment Practice Group, Mr. Photopulos discussed practical strategies for employers with government contracts, such as hospitals and other providers involved with Medicare, to settle potential “whistleblower” claims under the False Claims Act.  “Many employers do not realize that a settlement of all claims may not be enforceable with regard to potential False Claims Act whistleblower suits,” said Photopulos.  “The employer may unwittingly be funding the former employee’s next lawsuit.”

Photopulos is a member of the American Bar Association’s Labor and Employment Section, the American Health Lawyers Association, and the American Immigration Lawyers Association.  Recently, Photopulos was selected as one of the “Top Forty Under Forty” business professionals by the Memphis Business Journal.  Photopulos graduated from the University of Tennessee School of Law in 1997, where he was an editor of the Tennessee Law Review, served on the Moot Court Board, and was law clerk to Judge Houston Goddard, Presiding Judge of the Tennessee Court of Appeals, Eastern Section.
