Legal Experience
- In re Biodiesel of Mississippi, Inc. – Chapter 11 reorganization; resolution of temporary restraining order action filed by a creditor, environmental action by Mississippi Department of Environmental Quality an other issues; sold refinery in early 2007 for amount which should pay the creditors more than they would have received if the Chapter 11 case had not been filed. Case is still pending.
- In re Winn-Dixie Stores, Inc. et al. – Chapter 11 reorganization in Middle District of Florida; asserted claims for lease rejection damages and unpaid taxes and other expenses in excess of $1.1 million and resolved favorably the Debtor’s objections to a significant portion of our client’s claim one issue, as well as a related issue with our client’s secured creditor.
- In re Todd Phillips, Inc. – representation of Buyer of partially completed residential development in Lincoln County, Mississippi; buyer secured the status and protection of the “stalking horse bidder” and ultimately was approved as the buyer of development.
- In Re Premier Entertainment Biloxi LLC, d/b/a Hard Rock Hotel & Casino Biloxi. – Mississippi counsel to controlling shareholder in Chapter 11 reorganization case; shareholder is seeking to rebuild and reopen following devastation of Hurricane Katrina.
- In re Wickes, Inc. – Chapter 11 case in Northern District of Illinois (Chicago); negotiated settlement in which Complaint filed against our client was dismissed.
- In re Hill City Oil Company, Inc. – represented buyer in acquiring certain property from Debtor in Chapter 11 case filed New Orleans. Objected to sale of property to third party, and Court awarded property to our client.
- In re RealPure Beverage Group, LLC. – representation of secured creditor in Chapter 11 reorganization case of RealPure Beverage Group, LLC; worked to have company assets sold and payment of all debts, including all attorneys’ fees and expenses owed to Bank.
- In re Mississippi Chemical Company – Mississippi counsel for lead bank principal secured creditor in Chapter 11 case with claim in excess of $165 million; paid in full with interest and attorneys fees under a replacement DIP facility even before the Chapter 11 plan was confirmed.
- In re Alamo Transportation, Inc. – Represented buyer in purchase of warehouse and distribution facility in Memphis, Tennessee from Chapter 11 Trustee; Debtor challenged sale to our client and sought to reopen the sales process, but after extensive litigation, the Court confirm our client was rightful purchaser of property.
